Commonly known as the Construction Act, this legislation governs payment and dispute resolution in construction contracts. It provides parties with the right to refer disputes to adjudication and sets out rules regarding payment notices and the right to suspend work for non-payment.
You can only withhold payment if you serve a valid pay less notice within the timeframe specified in the contract. Failing to follow the correct procedure can leave you liable to pay the full amount claimed, even if the work is defective. Our solicitors can advise on the correct steps to take.
